In October of this year, the National Creditors Bar Association, a trade organization committed to serving those law firms and individuals who practice creditors rights law, held their 2018 Fall Conference, which also functioned as a 25th Anniversary Celebration for the association. ERC’s Vice President of Legal and Compliance, Shelly Gensmer, was invited to speak at the event, alongside representatives from law firms Lewis Brisbois and Strickler & Messer. 

The presentation, titled “Turning the Tables: How to Recover Attorney’s Fees from Consumers and Their Counsel for Manufactured or Fraudulent Claims,” was divided into three parts. The first part focused on how to identify a manufactured or fraudulent claim; the second honed in on the legal frameworks that attorneys could use to recover fees; and the final section highlighted a number of strategies that could be used in response to such claims. 

“It was an honor to be a part of the 2018 NCBA Conference alongside some of the industry’s best attorneys,” said Gensmer. “Hopefully the content of the presentation and the discussions which followed were valuable to our audience and to our peers. The topic of manufactured claims and sanctions is such an important one for the ARM industry.” 

This event was a valuable opportunity for ERC to expand its industry footprint, and become a greater authority on the important issues within the consumer collections industry. It also marked the first time that ERC has been asked to present at an NCBA conference, a milestone for the company and yet another indication of the strength of ERC’s legal team.
